CREMONA - A man facing a murder charge in the death of Cremona-area resident Brenda Ware will go to trial in March for a separate sexual assault offence alleged to have occurred while he was in custody on the murder count, according to court documents.
Philip Jeffrey Toner, 44, faces charges of second-degree murder, arson damage property, and interfering with a dead body, all from May 5, 2021.
Ware was last seen in Didsbury on May 4, 2021 and found deceased in Kootenay National Park near Radium, B.C. two days later.
Toner was arrested and charged on May 11, 2021 and held in custody without bail.
Between June 18, 2021 and July 2, 2021, Toner allegedly sexually assaulted a male, who cannot be named, at or near Calgary.
He is scheduled to go to trial on the sexual assault charge from March 18 to March 26 in Court of King’s Bench Calgary.
His trial on the Ware murder and arson charges was scheduled to be held Jan. 15 to Jan. 26 in Calgary Court of King’s Bench, but has been postponed pending a March 1 court date to speak to the case.
